By accessing or using our Website, dashboards, automation tools, business webpages, product display modules, subscription plans, or any related services (collectively referred to as the “Services”), you agree to be legally bound by this Terms of Service Agreement (“Agreement”).

1. Legal Entity Clarification

1qlik is a brand name operated by NEED PAC.

All payments, invoices, tax filings, contracts, and legal obligations are executed under the registered entity name NEED PAC.

References to “1qlik”, “we”, “us”, or “our” refer to NEED PAC.

2. Description of Services

1qlik operates as a Software-as-a-Service (SaaS) platform providing digital automation tools and business display infrastructure.

We provide digital, subscription-based automation tools, business profile webpages, product showcase modules, enquiry-enabled digital catalogs, and related dashboard services.

Service activation is deemed complete once login credentials, dashboard access, backend provisioning, hosting deployment, or automation enablement is granted.

• Automated SMS auto-reply services triggered by incoming calls or missed calls

All services are delivered electronically.

The Services operate through automation mechanisms configured on the user’s own device and/or mobile plan where applicable. 1qlik does not operate telecom infrastructure, SMS gateways, or carrier services.

Any message transmission occurs solely through the user’s registered mobile number and telecom provider.

NEED PAC reserves the right to modify, upgrade, redesign, restructure, or enhance the layout, interface, or features of business pages without prior consent, provided core service availability remains intact.

1qlik operates as a digital business display and communication enablement platform and does not function as a marketplace, broker, or payment intermediary.

3. Eligibility

By using our Services, you confirm that:

• You are at least 18 years of age.
• You are legally competent to enter into binding contracts.
• You are not prohibited under applicable Indian law from using such services.

4. Subscription & Payments

All subscription plans are prepaid.

By subscribing:

• You authorize recurring auto-debit in accordance with RBI e-mandate guidelines.
• Subscriptions automatically renew unless canceled before the next billing date.
• Non-payment, reversal, or payment disputes may result in immediate suspension of service.
• All payments are processed under the legal entity name NEED PAC.

Payments may be processed through third-party payment gateways. NEED PAC shall not be responsible for gateway processing delays, banking settlement cycles, or payment network failures.

5. User Conduct & Compliance

Users shall NOT use our Services for:

• Unlawful activities
• Fraudulent schemes
• Spreading malware
• Unauthorized marketing practices
• Sending unsolicited bulk communications

5.1 Anti-Spam Compliance

Users must comply with:

• IT Act, 2000
• TRAI regulations
• DPDP Act (as applicable)
• Third-party communication platform policies

Violation may result in:

• Immediate account suspension
• Permanent termination
• No refund entitlement

6. No Guarantee of Business Results

1qlik provides technological tools only.

We do not guarantee:

• Revenue growth
• Lead generation quality
• Conversion rates
• Business profitability
• Sales outcomes

7. Intellectual Property Rights

All platform components including source code, software logic, branding, logos, UI/UX design, and automation algorithms are the exclusive intellectual property of NEED PAC.

Unauthorized copying, resale, duplication, reverse engineering, scraping, or commercial exploitation is strictly prohibited.

8. Data Privacy & User Responsibility

Users retain ownership of their business data and confirm that uploaded content complies with Indian law and does not violate third-party rights.

9. Service Availability & Third-Party Dependency

NEED PAC shall not be liable for disruption caused by server downtime, hosting provider issues, regulatory changes, telecom operator restrictions, SIM suspension, or force majeure events.

10. Chargeback & Payment Disputes

Initiating a chargeback without first contacting support may result in immediate account suspension or permanent termination.

11. Suspension & Termination Rights

NEED PAC reserves the right to suspend or terminate accounts without notice or refund in cases of policy violation, fraud suspicion, legal non-compliance, abuse of platform, or regulatory risks.

12. Limitation of Liability

Under no circumstances shall the total liability of NEED PAC exceed the amount paid by the user during the current billing cycle.

13. Indemnification

You agree to indemnify and hold harmless NEED PAC from any claims, penalties, losses, damages, or legal costs arising from misuse of the platform or violations of law.

14. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts located in Satara, Maharashtra, India.

15. Modification of Terms

NEED PAC reserves the right to modify or update these Terms at any time. Continued use of Services constitutes acceptance of revised terms.

17. Dispute Resolution & Arbitration

Disputes shall first be attempted to be resolved amicably within 30 days. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The decision shall be final and binding.

18. SIM-Based Automation Acknowledgment

By using 1qlik Services, the user acknowledges that the platform provides digital facilitation only and telecom services are not provided by NEED PAC.

Message transmission compliance remains the responsibility of the user.
